Doctoral Student from the University of Lodz Wins Prestigious Cambridge Scholarship

Mgr Miłosz Gapsa studying at the University of Lodz Doctoral School of Social Sciences has been awarded the Polonia 2023 Scholarship funded by the Lauterpacht Centre for International Law at Cambridge University.

Thanks to the scholarship mgr Michał Gapsa will be able to go for a study visit to the Lauterpacht Centre for International Law, at the University of Cambridge in 2023 to conduct research entitled "Provisional measures indicated by the International Court of Justice and their effectiveness". It should be emphasised that our doctoral student was selected unanimously.

The popularity of provisional measures before the International Court of Justice is evidenced by the fact that they have been applied for in as many as 83% of cases initiated since 2020. However, their being ordered is no guarantee of compliance, as illustrated by Russia's behaviour despite the ICJ's order on 16 March 2022 to immediately halt the 'special military operation'. The question of their effectiveness is another issue, which may imply the use of provisional measures by a state to induce the other party to make certain concessions, as in the case of the recent application of Germany against Italy. The purpose of my scholarship in Cambridge will be to have a closer look at provisional measures in terms of their effectiveness and the reasons why states choose not to comply with them
